Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a binding agreement between you and Ghimire Labs ("Ghimire Labs," "we," "us," or "our"), the company that builds and operates Drishya (the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

Drishya lets you describe an educational topic in plain language and generates a narrated animated video from it, using large language models to plan and write scenes and text-to-speech models to narrate them. The Service includes a guided "Generate" flow and a scene-by-scene "Studio" editing mode.

3. Eligibility

You must be at least 13 years old to create an account. If you are between 13 and 18 years old, you may only use the Service with the involvement and consent of a parent or legal guardian, who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

4. Accounts

You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@ghimirelabs.com if you suspect unauthorized access. We support sign-in via email/password and Google OAuth through Firebase Authentication.

5. Billing, Plans & Credits

Drishya offers a free plan and paid subscription plans (Starter, Pro, Creator), each with a monthly credit allocation used to generate and render videos, plus optional one-time add-on credit packs. Paid plans are billed in advance on a recurring basis through Stripe, our payment processor — we do not store your full card number. You can cancel a subscription at any time; cancellation takes effect at the end of the current billing period, and unused credits do not carry over unless stated otherwise at time of purchase. Fees are non-refundable except where required by law or as we expressly agree in writing.

6. AI-Generated Content — Please Read Carefully

This section is important. Drishya's videos, narration scripts, and diagrams are produced automatically by third-party AI models with no human review before they're delivered to you.

• Accuracy is not guaranteed. AI models can produce factually incorrect, outdated, incomplete, or misleading content, including on educational and scientific topics. You are responsible for independently verifying any fact, figure, date, or claim in generated content before relying on it, teaching it, publishing it, or sharing it with others.
• Not professional advice. Nothing generated by the Service constitutes medical, legal, financial, safety, or other professional advice, even if it discusses those topics.
• Not intended for high-stakes use. Do not rely on Drishya-generated content in situations where factual errors could cause harm (e.g. medical dosing, safety-critical instructions, legal filings) without independent expert verification.
• Depictions of real people or events. If you prompt the Service to generate content about real, identifiable people, you're responsible for ensuring that use is lawful (including publicity, defamation, and privacy laws) and not misleading about what is AI-generated.

7. Your Content

"Your Content" means the topics, prompts, source text, URLs, and images (PDFs, reference material, uploaded assets) you submit to the Service. You represent that you have the necessary rights to submit Your Content and that it doesn't infringe or violate any third party's rights or any law. We process Your Content to generate output and, where you've enabled it, to ground narration in your source material.

8. Intellectual Property

As between you and Ghimire Labs, and subject to your compliance with these Terms and payment of any applicable fees, you own the videos generated from your prompts and may use, publish, and distribute them, including for commercial purposes. This does not transfer any rights in the Drishya platform itself, our software, branding, or underlying models, which remain owned by Ghimire Labs and our licensors. Because output is produced by third-party AI models, we cannot guarantee that any given output is free of third-party intellectual property claims, and we make no representation that output is eligible for copyright protection in every jurisdiction.

9. Third-Party AI Services

To generate scenes, narration, and search results, the Service sends relevant parts of Your Content (such as your topic and any source text) to one or more of the following third-party providers, depending on configuration: Anthropic (Claude), Google (Gemini and Vertex AI), OpenAI, ElevenLabs (text-to-speech), and Exa (search). These providers process that data under their own terms and privacy policies to return results back to Drishya. See our Privacy Policy for details on what's shared and why.

10. Prohibited Uses

You agree not to use the Service to:

• Generate content that is illegal, defamatory, harassing, or infringes another's rights;
• Generate deliberately false or misleading educational content intended to deceive;
• Generate sexually explicit content involving minors, or any content exploiting minors;
• Attempt to extract, reverse-engineer, or bypass the Service's underlying models, prompts, or rate/credit limits;
• Upload source material you don't have the right to use;
• Resell or redistribute API-level access to the Service without our written permission;
• Interfere with or disrupt the integrity or performance of the Service.

11. Suspension & Termination

We may suspend or terminate your access if you violate these Terms, misuse credits or the underlying AI providers, or if required to comply with law. You may stop using the Service and delete your account at any time by contacting support@ghimirelabs.com.

12. Disclaimers

THE SERVICE AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHIMIRE LABS AND ITS OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON GENERATED CONTENT — INCLUDING FACTUAL ERRORS IN AI-GENERATED MATERIAL — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

14. Indemnification

You agree to indemnify and hold Ghimire Labs harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where required, notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles, and any dispute will be resolved in the state or federal courts located in Delaware, unless applicable law in your jurisdiction requires otherwise.
